State Court Hears Calvin Harris Appeal
ALBANY, NY (WENY) -- Eleven years to the day he was accused of murdering his wife, Calvin Harris' attorneys are in the state's highest court, trying to reverse his murder conviction.
The New York state Court of Appeals is hearing the case today in Albany. Harris' lawyers say there was insufficient evidence to convict him. You may remember, Harris was convicted twice; first in 2007, a conviction that was later dismissed when a surprise witness came forward after the trial. Harris was convicted again in a 2009 re-trial.
Prosecutors say Harris killed Michele the night of September 11, 2001; neither a murder weapon or her body has never been found.
The court is expected to make a ruling next month.
