ALBANY (WENY) -- Parole for convicted murderer Eric Smith was been denied for a fifth time. The parole board cites release is not warranted "due to concern for the public safety and welfare" and release would "not be compatible with the society at large, and would tend to depreciate the seriousness" of the crime. The board also notes the community opposition to Smith's release.
Smith murdered four year old Derrick Robie in 1993, by stranguling him, and hitting him in the head with a large rock. Smith also sodomized Derrick with a stick.
Smith was convicted in 1994 and sentenced to nine years to life in prison. He is now eligible for parole again in 2014.
