Bath Teacher Acquitted
BATH - [WENY] Bath Middle School Teacher Jim Cain says he was dumbfounded when he learned a 13 year old female student accused him of intentionally touching her breast back in October 2012. A friend of the girl came forward as a witness. He was charged, and removed from the classroom.
Jim Cain said, "It just came out of the blue, it was an hour after the alleged event, and it was just shocking, nothing seemed to have happened"
Cain maintains he never even touched the girl, and he just pointed to, and commented on a carnation she was wearing on her dress during class.
"To think I would do something like this in a classroom of 16 students, it was just illogical.", Cain said.
After a 2 day trial and testimony from 15 witnesses, a jury of 6 deliberated for less than 10 minutes and came back with a verdict of not guilty. Defense lawyers discredited the prosecutions witness testimony. That ended Cain's 10 month ordeal, and after thousands of dollars were spent on attorney and investigative fees.
Cain said, "I feel just so vindicated, just so relieved, it will actually take a little while to feel fully glad and resolve it."
Jim Cain retired from the Bath Central School District after 22 years of teaching. Bath Superintendent Joe Rumsey commented on the case saying he was happy to see closure. The Assistant DA who prosecuted the case said the system worked, and the jury did its job.
