Custody Battle Arrest in Avoca

AVOCA (WENY) -- A custody dispute led to one arrest. 59 year old Edith Plummer of Avoca was charged with assault and criminal possession of a weapon after hitting 24 year old Jonathan Tyler with a small sledge hammer, police say.
     State Police in Bath say it happened at Plummer's home on County Route 7. According to police investigation, Tyler was going to pick up his child for a court ordered visitation. When he arrived, Plummer refused to turn the child over to Tyler. When Tyler refused to leave, Plummer kicked him several times in an effort to get him off her porch. When he still did not leave Plummer retrieved a small sludge hammer from the residence and hit Tyler several times in the chest. He disarmed her and reported the incident to Steuben County 911.
     Tyler was taken to Ira Davenport Memorial Hospital in Bath, where he was treated and released for non life threatening injuries.
     According to police, Plummer was arraigned before Avoca Town Justice John McCarthy and released.
