Day 1: Justin Jones Murder Trial
ELMIRA---(WENY) It was 'The Nightmare at Alexander Place', a nightmare that started for his mother the night before Brian 'Bear' Martin was killed, according to John Thweatt of the Chemung County District Attorney's office . As each side presented opening statements, we learned that Brian Martin and Justin Jones were friends. They were friends who hung out together and friends that did drugs together according to the defense.
According to Jones' attorney, Joseph Joch, Brian was known for giving rides to people. The night Brian was killed he reportedly gave his female friend a ride, after hanging out with Jones earlier that day. According to statements from both the prosecution and defense, they watched movies and ordered Chinese food. Then Justin had a few shots of tequilla and shortly thereafter, fell ill. That's when the she called Brain for a ride home, around 11:00pm November 7th. After Brian dropped her off, he got a call from Justin, asking for a ride around 1:50am November 8th, according to the defense. That's the last anyone heard from Brian.
After Brian was killed, the prosecution says Jones called his landlord at the place he was staying temporarily, 317 Alexander Place in Elmira. Jones asked him to bring bleach and trash bags. When the landlord, brought the items to Jones and went inside the apartment, he noticed blood stains on the carpet, according to the prosecution. Jones reportedly told the landlord that he'd cleaned up the best he could and that he owed him new carpet. When the landlord asked Jones who he was talking about, he replied, "A guy named Brian."
According to the prosecution, Justin went on to tell the landlord that he had to use some of the kitchen knives and advised him not to use the meat cleaver if he plans on cooking.
The landlord, who is also an informant for the NYSP regarding drug activity, later tipped off the state police.
Later that morning Brian's mother found him in the trunk of her black Chevy Equinox. His body was wrapped in a purplish-gray sleeping bag with a single bullet wound to the back of his neck and his right leg nearly severed.
A toxicology report showed Brian had lethal doses of heroin in his system at the time of death. Brian's mother took the stand saying Brian was a recovering addict, but had no knowledge that he had used since last April.
