      ELMIRA, NY (WENY) -- A libel and slander lawsuit against Elmira City School district and two board members has settled out of court.
       Former Assistant Superintendent Robert Gosden sued board members Dan Hurley and Lynn Grottenthaler for libel and slander. Gosden retired as Assistant Superintendent for ECSD in 2006. In 2009, he sued the district, Hurley, Grottenthaler for comments they made during a board meeting, and to the Star Gazette in 2008.
       The two board members were upset Gosden was hired to teach a seminar on financial responsbility and accountability, after a report uncovered a $35,000 dollar payment to Gosden for unused vacation time he was not entitled to, part of $100,000 dollars paid to employees and GST BOCES without school board approval.
     The court clerk tells WENY TV News the terms of the settlement were not disclosed.
