Biltmore Crossings Court Ruling

     CHEMUNG CO. (WENY) --  An update on the controversy surrounding the Biltmore Crossing project....a supreme court judge has ruled the project can move forward, because the complaint was outside a 4 month statute of limitations.

     A group of Horseheads residents were in court two weeks ago trying to get the approval decision made by the Horseheads Town Board dismissed.  They argued that decision was invalid, and wanted to see the building permit thrown out.

     In a court document WENY obtained on Tuesday, Judge Judtih O'Shea denied and dismissed that request, meaning the project move forward.

     The 56-unit apartment low income complex is slated to go in at Gardner Road and Biltmore Drive.  Many of the local neighbors say they're worried the affordable housing project will hurt their community and property values.
