TIOGA, N.Y. (WENY) – The Tioga County, New York man accused of murdering his 8-month-old daughter last summer has been indicted on two counts of second-degree murder, according to our media partner The Star Gazette.

As WENY News reported – 25-year-old Cody Franciscovich was arrested in June after New York State Police responded to a 911 call saying a baby girl, Ruby Franciscovich, had gone missing from the Deepwell Motel off of State Route 17C in the Town of Tioga.

Troopers say they arrived and started to search for Ruby. They say they were told she was last seen at the hotel with her father, Cody.

Shortly after that, Troopers responded to another call reporting that just west of the hotel, there was a man who was naked. Troopers arrived and determined that man was Franciscovich.

Troopers say Franciscovish directed them to a pond, where they found Ruby dead.

Franciscovich was initially arrested on first degree murder charges and sent to the Tioga County Jail, where he still remains. He pleaded not guilty at the time.

If convicted of the second-degree murder charges, Franciscovich could face up for 25 years to life in prison.

Tioga County Court officials tell WENY News, Franciscovich's next court date has not yet been scheduled.
