One person charged after fatal motorcycle crash in Nichols, N.Y.

UPDATE (10/4): The Tioga County Sheriff's Office announced Friday that they have charged an Athens man in connection to the death of a motorcyclist in Nichols on Sept. 16.
Law enforcement say Jack Lineburg, 58, allegedly hit and killed 64-year-old Calvin Pierce of Barton and hurt another passenger while they were on a motorcycle that was stopped and waiting to turn off of the roadway.
Officers say Lineburg was drunk and driving too fast.
He is charged with Aggravated Vehicular Homicide, Aggravated Vehicular Assault, Driving While Intoxicated, Driving While Having a Blood Alcohol Content Greater than .08%, Aggravated Unlicensed Operation and other traffic violations.
Lineburg was arraigned and sent to the Tioga County Jail in lieu of $10,000 cash bail. He is due back in court at a later date.
Police say the passenger on the bike is in stable condition and is recovering.
TIOGA COUNTY, N.Y. (WENY) -- The Tioga County Sheriff's Office announced on Thursday, September 19th that 64-year-old Calvin Pierce of Barton has succumbed to his injuries after being injured during a motorcycle crash that happened on West River Rd. in Nichols on Monday, September 16th. His passenger at the time, 45-year-old Carla Pierce, remains in critical condition.
Police say the crash happened shortly after 8 p.m. when the motorcycle the pair were on was involved in a crash with a car. Both Calvin and Carla were thrown from the bike, and when police arrive, they detained the person operating the car.
No charges have been announced, but the Tioga County Sheriff's Office said that charges are pending, and that the investigation into the crash is still ongoing.
