Elmira Criminal Trespass Investigation

UPDATE: 8:55 AM: ELMIRA (WENY)-- Elmira Police Captain, Joseph Kain tells WENY-TV that this case now stands as a criminal trespass.

 The investigation reveals Marquis Merill was allegedly under the influence of drugs and/or alcohol at the time of the trespass.

According to the investigation, the suspect thought the home at 521 Fulton was his own, opened the door, and walked in the house. The homeowners then hit him with a hatchet. He is now at Saint Joseph's Hospital and under police supervision.

ELMIRA (WENY)---Breaking news out of Elmira this morning.

Elmira police say a suspect in a home invasion is injured after trying to break into a house at 521 Fulton Street.

Police say it happened around 1:30 this morning.

The suspect, 30-year-old Marquis Merill of Elmira was injured in an altercation with the homeowner and is now being treated at Saint Josephs Hospital under police supervision.

The homeowner is not injured.
