ELMIRA, N.Y. (WENY) -- An Elmira man accused of making meth inside of a backpack, has been indicted by a Chemung County Grand Jury.
According to the DA's office, 38-year-old Philip Whitehead was indicted on criminal possession of a controlled substance.
As we reported earlier this month, Whitehead was arrested after police say they allegedly saw him attempt to give a backpack to someone else on Oak Street.
The other man was Brent Crandall, who was charged with attempted criminal possession. Police say Whitehead already had a warrant out for his arrest during the incident.
Police say when they opened the backpack, they found what appeared to be a "one-pot" meth making system. If convicted, Whitehead could face up to 10 years behind bars.
