TIOGA, N.Y. (WENY) -- The case against a father accused of killing his infant daughter in the town of Tioga will go before a grand jury.

25-year-old Cody Franciscovich appeared briefly in Tioga Town Court on Friday for a felony hearing, which he waived.

He was charged with first-degree murder after state police say he killed his eight-month-old daughter Ruby and left her in a pond.

According to a felony complaint, Franciscovich is also accused of raping the infant.

Police were called to the Deep Well Motel in Owego last weekend when Ruby was reported missing.

Troopers also received calls of a naked man spotted near the motel, which is when they located Franciscovich, who directed them to the pond where he left his daughter.

Franciscovich is being held in Tioga County Jail without bail.

No word yet on when he will appear before a grand jury.

A memorial has been set up for Ruby, and a vigil will be held this evening at 8 p.m. at Saint Patrick's Cemetery, located at 16 Court Street in Owego.  Attendees are encouraged to wear red.
