(WENY) -- A New York State regulation for new and existing mobile food preparation vehicles has some local food trucks no longer in compliance, leaving them unable to take part in some community events.  

The requirements and regulations for operating food trucks went into effect in May of 2020. But in some places, the rule is just now being enforced.  

New York State’s Building Standards and Codes state food trucks are required to have a kitchen exhaust hood and automatic fire extinguishing systems. Even if a food truck does not cook hot food, these features are still required in order to be in compliance. 

Not all local food trucks are equipped with these systems, which could affect their presence at local events, farmer’s markets, and other locations.  

“Across New York State and Corning, New York, and the Gaffer District...for those of us who invite food trucks to be a part of our events, the local municipalities are responsible for looking at the food trucks where this is applicable and determine whether or not they are eligible for the operating permit,” Coleen Fabrizi, Executive Director of Corning’s Gaffer District, said.  

Food trucks that were legally in operation prior to May 12th, 2020, are grandfathered in and are not required to comply with these provisions.
